Patentability search is done before preparing the patent application to determine whether the invention is novel and non-obvious or not for patenting based on the published prior art that currently exists.

Our clients receives a concise search report containing citations to sections of the prior art found, our comments on each cited prior art and electronic copies of the prior art documents. The results of a search and a patentability opinion are provided within 5 days.

Infringement / Freedom to Operate Search :
Infringement / Freedom to operate search is performed to check whether product or implementation client’s invention will lead to infringement of others patented products or patent applications. Infringement or Freedom to operate search should be done by clients before committing to develop, produce and/or launch a new product in the market. This search invariably begins by a search of patent literature for issued or pending patents and determining on whether a product, process or service may be considered to be infringing existing patent(s) owned by others. Search is conducted as a due diligence effort to avoid infringement. At Intepat, patent searches are performed by technical experts having extensive patent search experience. We would present this search report within 10 days.

Validity/Invalidity Search :
The purpose of validity/invalidity search is to determine whether a patent issued on a invention is valid or not in view of prior art that was already published as of the priority/ filing date of the patent application. To put it in a simple way, it is an extensive and comprehensive patentability analysis. In Validity/Invalidity search, information from prosecution history or file wrapper is mainly considered while doing analysis of search results.

Invalidity search report typically consists of search report, claim chat and electronic copies of cited prior art. Our invalidity searches provide clients with expert analysis as to possible invalidating art that can be declared against an issued patent. The purpose of patent watch is to keep the records on the new inventions coming in a particular field of technology. We can send patent alert through email for people interested in patents.
