Arbitration Related Litigation in a mode for settlement of disputes between the parties. It has a social purpose to fulfill. The Arbitration and Conciliation Act, 1996 has substantially reduced the intervention of Courts to the minimum level and has helped the speedy conclusion of the arbitration proceedings. But certain issues which arises arbitration or post Arbitration can be settled only through the Court of Law. 

 

The following are the situations in which only Courts can settle the issues:

 

Interim orders to protect the interest of parties before the commencement of the arbitration proceedings

Appointment of arbitrators as per the Arbitration clause when there is a delay or dispute between the parties to appoint an arbitrator

The appeal against the arbitration award or awards after the conclusion of the proceedings
